Process to apply for an H-4 Visa

The application process for an H4 visa depends on whether the applicant is applying from overseas or within the US. A dependent can apply simultaneously with the principal applicant or separately at a later date.

  • When applying from overseas, the applicant needs to submit an online application using Form DS-160 and schedule a visa interview at the local US Embassy or Consulate.
  • If the applicant is already in the United States on a different nonimmigrant visa, they can apply for an H4 visa through USCIS using Form I-539.
  • For those already in the US, changing non-immigrant status to H4 classification may take several months. However, filing the application before the expiration of existing lawful status allows the H4 visa applicant to stay in the US pending the outcome.
